Good Afternoon All, I am sure you have many questions regarding how we are supposed to operate in the next few weeks. The Governor signed an executive order (see attached) last night mandating that all non-essential businesses reduce workforce by 50% no later than 8:00 pm, March 20, 2020. On the executive order it doesn't state auto repair shops and gas stations as essential businesses. Our attorney is sending a request to the Empire State Development Corporation requesting them to determine such businesses essential. We are diligently working on your behalf to protect your places of business and answer any questions you may have. There have been many calls to our office and many questions asked. One question was "Do we pay vacation and sick time first?" The answer is yes. If you offer vacation and sick time, the employee that is getting laid off will receive their vacation and sick pay first and then they will receive unemployment. Unemployment will ask the claimant if they have vacation and sick time and ask the employer as well. As I get more answers I will revert back to all of you to let you know and keep you updated on what is happening with the current crisis.
